Definitions

Unless otherwise required by the context, the following words and phrases shall have the following meanings: "KIENA JEWELLERY", "WWW.KIENA-JEWELLERY.CO.UK" "us" or "we" means KIENA JEWELLERY of Cwmbach, Glasbury-on-Wye, HR3 5LU. 'KIENA JEWELLERY' and the website 'WWW.KIENA-JEWELLERY.CO.UK' is owned and operated by Jane A. Allwright of Cwmbach, Glasbury-on-Wye, HR3 5LU.

"Merchandise" means Jewellery, accessories and other products on sale on the KIENA JEWELLERY' website.

 "Website" means the KIENA JEWELLERY' website for the sale of Merchandise at www.kiena-jewellery.co.uk

 "You" "your" or "customer" means the person placing an order for Merchandise with KIENA JEWELLERY;

By submitting an order to KIENA JEWELLERY for the purchase of any product and using this website you acknowledge that you have read and you agree to be bound by and comply with these Terms and Conditions (Customer Terms).

If you do not accept the Terms and Conditions you will not be able to proceed with your purchase. We reserve the right to revise and amend the Website, our disclaimers and the Customer Terms at any time without notice to you so please review at the time of order.

Your continued use of the Site (or any part thereof) following a change shall be deemed to be your acceptance of such change. Your statutory rights are not effected. Please also read our privacy policy regarding personal information.

Imagery/Description of Merchandise

While we do our best to illustrate the merchandise as effectively as possible, as many items of jewellery are hand-made with natural stones, images on the website do not necessarily reflect each individual items' actual colour or size. Also colours reproduced are as accurate as electronic processes allow and may have slight variation on different browsers.

While we endeavour to ensure that all information is both as accurate and as up-to-date as possible, KIENA JEWELLERY does not guarantee that product descriptions, or other content of this site, is without error.

All Merchandise is subject to availability.  In the event of the unavailability of an item which has been ordered, we will advise you and, as agreed with you, either send a suitable replacement or arrange for a full refund.

Affiliates

Please note that at present KIENA JEWELLERY is not offering an Affiliates Programme.

Pricing of the Merchandise

The price of the Merchandise will be as stated on our Website at the time that you submit your order.

As we are not as yet registered for Vat, the prices stated on the Website do not include this tax.

Payment

Payment is made through PayPal, (or, if preferred and agreed, by Bank Transfer). Your order will be automatically acknowledged by email and, upon receipt of payment in cleared funds, you will advised of the despatch of the merchandise.

Order Confirmation

An order will not be deemed accepted by us until we have received payment for the Merchandise in cleared funds.

Notwithstanding any written electronic confirmation of an order which you receive from us, KIENA JEWELLERY reserves the right to decline orders and any payment made will be immediately refunded in full.

Occasional sale discount may be offered and is given on merchandise only.

Our acceptance of your order brings into existence a legally binding contract between us. Only persons aged 18 and over are entitled to enter into legally binding contracts and, as a result, are the only people entitled to transact through this site.

Delivery Charges:- Mainland UK - Orders in excess of £50, delivered within the UK Mainland, will be delivered FREE OF CHARGE. Orders of less than £50 will be subject to £5 Postage and Packing. Please enquire about delivery charges for any non UK mainland destinations. Export delivery charges will be charged at cost.

Subject to confirmation of payment and availability of the selected item, we aim to arrange shipment of most orders on the same day, but please allow 2-5 working days for receipt. In the event of an item not being immediately available the customer will be advised with details of the likely time for its availability. Delivery will be made to the address specified by you in your online order form. While every attempt will be made for effective and quick delivery, we cannot accept liability for loss resulting from late delivery.

Returns

We want you to be pleased with your purchase, and if it's not quite right we're happy to offer an exchange for another size, design or give you a refund. With respect to bags, scarves and gloves etc. please return the item unused,with the original label/s.

You can return the item to KIENA Jewellery for a full refund or exchange within 28 days of the receipt of the item. To do this, please follow the steps below:

Contact KIENA JEWELLERY, via email or the website Contact form, detailing your order number, the item you would like to return and the reason for return.

Pack up your return in its original packaging. If you do not have the original packaging make sure you pack the items so that they cannot get damaged in transit. If we receive any item(s) in a used or unsaleable condition; we will not be able to offer any refund. Please note at this time we are unable to refund return postage. 

Return postage is at the customer's expense and for peace of mind, please return by a Royal Mail tracked delivery. For more expensive items, particularly of jewellery, it is advised that they should be sent by recorded delivery.

Refund - Once your order has arrived at KIENA Jewellery, we will issue the appropriate refund. We aim to do this within 48 hours of receipt, however, during busy periods this can sometimes take longer.

A Note on Postage and Returns

As a small indie business, we’re not able to cover postage costs on standard returns, (when there’s no fault with the item). This means we’ll need to deduct the original postage fee from your refund.

Damaged or Faulty Items

In the unlikely event that an item is delivered damaged or faulty, it must be reported to KIENA JEWELLERY, via email or the Contact form on the website, as soon as possible and within 3 working days of receipt of delivery, accompanied by full details of the order number and date of ordering. Products must then be returned within 7 working days of the date of receipt. Return postage is at the customer's expense and for peace of mind, please return by a Royal Mail tracked delivery. For more expensive items, particularly of jewellery, it is advised that they should be sent by recorded delivery. Proof of posting will be required in the unlikely event of the returned product not being received by KIENA JEWELLERY.

If a package appears to have suffered damage during delivery, keep the original carton, promptly contact the courier and request that the courier returns the merchandise.

Items will only be credited if the damage to the merchandise occurred prior to delivery, or if it is clear that there is a manufacturing fault. Items considered to have been mistreated or damaged through wear and tear cannot be credited. Subject to agreement, the item will either be replaced by a product of equivalent value or a refund made. Please note that, unless damaged prior to delivery or faulty in manufacture, earrings cannot be returned for hygiene reasons.

Please note: Intimate items, such as Earrings, are not able to be refunded or exchanged unless received faulty.

Availability

All products are subject to availability.  In the event of the unavailability of an item which has been ordered, we will advise you and, as agreed with you, either send a suitable replacement or arrange for a full refund.

Cancellation

You have the right to cancel an order prior to despatch by email to: sales@kiena-jewellery.co.uk. You will also be entitled to cancel your order by notice to us at any time up to 7 days after the date of delivery of the Merchandise, in which instance the goods must be returned to our contact address in the original condition and packaging at your own cost and risk. If you cancel your order but we have already processed the Merchandise for delivery, you must not unpack the Merchandise when it is received by you and you must send it back to us at our contact address at your own cost and risk as soon as possible and within 10 working days.

Once you have notified us that your are cancelling your order, any sum paid to us via PayPal will be re-credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the Merchandise in question is returned by you and received by us in the condition it was in when delivered to you.

Intellectual Property

The entire content of the Website, including all copyright, trademarks and other intellectual property rights it contains, is the sole property of KIENA JEWELLERY or as relevant contracted third parties. You are permitted to use such material only for the purpose of ordering Merchandise from the Website, and you are not entitled to copy, reproduce, transmit, display in public, create derivative works from or otherwise commercially exploit such material.

General

English law shall govern the contract between you and KIENA JEWELLERY, and you and KIENA JEWELLERY submit to the non-exclusive jurisdiction of the English Courts.

If any clause or part of a clause in these Terms and Conditions is held by any Court of competent authority to be unlawful, invalid or unenforceable, such clause or part shall be severed and the remaining provisions of these Terms and Conditions shall remain in full force and effect.
